1. Who we are
Niryatify is a cross-border shipping platform operated by CLINIVISTA TECH LLP, a Limited Liability Partnership incorporated in India (LLPIN ACU-9960), with its registered office at A-79, 1st Floor, Block-A, Goun Mandi Prangan, Muhana, Sanganer, Jaipur, Rajasthan – 302029, India. In these Terms, "Niryatify", "we", "us" and "our" refer to CLINIVISTA TECH LLP. "You" and "your" refer to the person or organisation using the platform.
2. What Niryatify does
Niryatify is a technology platform that helps you prepare, book, pay for and track international parcels that are carried by India Post. We simplify India Post's international booking process, generate the required customs documentation, allocate article (tracking) numbers, and pass your shipment details to India Post for acceptance and carriage.
The physical carriage, transport, customs clearance and delivery of your parcel are performed by India Post and its partner postal operators, and are subject to their rules, timelines and the Universal Postal Union conventions. Niryatify is not a carrier and does not itself transport goods.
3. Eligibility and accounts
To use Niryatify you must be at least 18 years old and able to enter into a binding contract. When you register, you agree to provide accurate, current and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
4. Booking a shipment
When you create a booking you confirm that:
- the sender and receiver details, item descriptions, HS codes, declared values and weights you provide are true and accurate;
- the contents of your parcel are lawful to export from India and to import into the destination country, and are not prohibited or restricted items;
- you are the owner of the goods or are authorised to ship them, and you will comply with all applicable export, customs and postal regulations.
A booking is only complete once payment is received and India Post accepts the shipment. We may decline or cancel a booking if the details are incomplete, the contents appear to be prohibited, payment fails, or India Post is unable to accept the article.
5. Prohibited and restricted items
You must not ship any item that is prohibited by India Post, by the Universal Postal Union, by Indian export law, or by the laws of the destination country. This includes (without limitation) dangerous goods, hazardous materials, currency, weapons, narcotics, perishables that cannot survive transit, counterfeit goods, and anything whose export or import is restricted. If you ship a prohibited item, your parcel may be seized, returned or destroyed by the authorities, and you remain fully responsible for any resulting loss, fine or penalty.
6. Pricing and payment
The price for each shipment is calculated from India Post's tariff for the selected product, weight, dimensions, destination and any value-added services (such as insurance). Applicable taxes are shown before you confirm. Payment is collected in advance through our payment partner, Razorpay, or debited from your Niryatify wallet where you have pre-funded it. 7. Customs, duties and taxes
International shipments may attract customs duties, taxes or charges in the destination country. Unless expressly stated, these are the responsibility of the sender or receiver and are not included in the price you pay to Niryatify. You are responsible for the accuracy of the customs declaration (including declared value and HS codes). Under-declaring value or mis-describing contents is a customs offence and is strictly prohibited.
8. Tracking and delivery
Once your article is booked, Niryatify provides a tracking number and status updates sourced from India Post. Delivery timelines are estimates provided by India Post and are not guaranteed by Niryatify. Delays may occur due to customs, weather, postal backlogs or events outside our control.
9. Liability
Niryatify provides the booking and documentation platform. Liability for loss of or damage to a parcel in transit, where it exists, rests with India Post and is limited to the compensation provided under the applicable postal rules and Universal Postal Union conventions, and to any insurance cover you have purchased for the shipment.
To the maximum extent permitted by law, Niryatify's total liability to you for any claim arising out of or in connection with the platform or a booking is limited to the platform service fees you paid to us for that booking. We are not liable for indirect, incidental or consequential losses.
10. Your responsibilities
You agree to use Niryatify only for lawful purposes, not to attempt to disrupt or gain unauthorised access to the platform, and not to submit false, misleading or fraudulent information. You are responsible for packaging your goods adequately for international transit.
11. Suspension and termination
We may suspend or terminate your access to Niryatify if you breach these Terms, if we are required to by law, or if we reasonably suspect fraud or misuse. You may stop using the platform at any time.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, where appropriate, notify you. Continuing to use Niryatify after an update means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of India. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
